Terms of Service

Last updated: July 12, 2026. These Terms govern access to Min Fire v3 / nestingoptimizer.com worldwide. By creating an account or using the Service, you agree to these Terms.

1. Parties

These Terms are between ZAKKAS Design (“we”, “us”, “Service Provider”) and the individual or organization using the Service (“you”, “User”).

2. The Service

Min Fire v3 is a cloud-based cutting optimization SaaS. Depending on your subscription, tools may include linear/bar cutting, angled cutting, and sheet/plate nesting. Outputs are algorithmic suggestions (for example cut lists and plans) and related account features such as calculation history and quotes.

3. Accounts

You must provide accurate information and keep login credentials confidential. Accounts are for authorized use only. Sharing credentials or concurrent unauthorized multi-location use may result in suspension or termination without refund. You are responsible for activity under your account.

4. Acceptable Use

You may not: reverse engineer the Service; attempt to bypass access controls; abuse the platform; upload unlawful content; or use the Service in a way that harms other users or our infrastructure.

5. Important disclaimer — cutting results

a) Optimization results are mathematical/algorithmic estimates based on the data you enter.
b) Before any physical cutting or material processing, you must have plans checked by qualified workshop or technical staff.
c) We are not liable for incorrect cuts, scrap, downtime, lost profits, or other damages arising from software output or user input errors. Starting production means you accept full responsibility for shop-floor decisions.

6. Intellectual property

The Service, software, branding, algorithms, and related materials remain our property (or our licensors’). You receive a limited, non-exclusive, non-transferable right to use the Service during an active paid or demo period, subject to these Terms.

7. Fees, currency, and taxes

Subscription prices are listed on the website in USD unless otherwise stated. Payments are processed by our payment provider (currently iyzico). You are responsible for any applicable taxes, duties, or bank/card fees charged by your provider.

8. Subscriptions, demos, and cancellation

Paid plans grant access for the purchased period. Demo access, if granted, is limited and may be revoked. You may request cancellation according to the Refund Policy and in-app cancellation rules. Access continues until the end of the then-current paid period unless we state otherwise.

9. Availability

We aim for reliable uptime but do not guarantee uninterrupted Service. Maintenance, force majeure, or third-party outages may occur.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising from the Service is limited to the fees you paid to us for the Service in the three (3) months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or business opportunity.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Turkey. Courts and enforcement offices of Bursa, Turkey shall have exclusive jurisdiction, unless mandatory consumer protection laws in your country require otherwise.

12. Changes

We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance of the updated Terms.

Privacy Policy

Last updated: July 12, 2026. This Policy explains how ZAKKAS Design processes personal data when you use nestingoptimizer.com and Min Fire v3. Users in Turkey should also read the Turkey Data Notice (KVKK).

2. Data we collect

• Account data: name, email, Google account identifiers/avatar (via Google Sign-In)
• Billing data: billing type, tax/ID numbers you provide, phone, country, city, district/state, address
• Usage data: calculation/project inputs and results you save, quotes, subscription status, support messages
• Technical data: IP address, browser/device info, session tokens, approximate logs for security
• Payment data: payment status and references from our processor; we do not store full card numbers on our servers

3. Why we process data

• Provide and secure the Service (contract / legitimate interests)
• Process subscriptions and invoices (contract / legal obligation)
• Customer support and service communications (contract / legitimate interests)
• Improve algorithms in aggregated/anonymous form where feasible (legitimate interests)
• Marketing only where allowed and, where required, with consent
• Comply with law and prevent fraud/abuse

4. Sharing

We may share data with: payment providers (e.g. iyzico), hosting/infrastructure vendors, analytics/ads tools we configure (if enabled), professional advisors, and authorities when legally required. We do not sell your personal data.

5. International transfers

Our Service is operated from Turkey and may use vendors in other countries. Where required, we use appropriate safeguards for cross-border transfers.

6. Retention

We keep account and billing records as long as your account is active and for a reasonable period afterward for legal, tax, and dispute purposes. You may request deletion subject to legal retention duties.

7. Security

We use HTTPS/SSL and access controls. No method of transmission or storage is 100% secure.

8. Cookies and similar technologies

We use cookies/session storage for login, security, preferences, and (where used) analytics/advertising. You can control cookies via your browser settings; some features may not work without essential cookies.

9. Your rights

Depending on your location (for example GDPR/UK GDPR or similar laws), you may have rights to access, correct, delete, restrict, object, portability, and withdraw consent. Contact support@nestingoptimizer.com. You may also complain to your local data protection authority.

10. Children

The Service is intended for business/professional use and is not directed to children under 16.

11. Changes

We may update this Policy by posting a new version on this page.

Refund Policy

Last updated: July 12, 2026. Applies to USD SaaS subscriptions purchased on nestingoptimizer.com.

1. Digital delivery

Min Fire v3 is delivered online immediately after successful payment (or when a demo is activated). There is no physical shipment.

2. No refund after activation

Because access is granted immediately as digital content/service, purchases are generally non-refundable once the subscription or demo access is activated, except as stated below. By completing payment you acknowledge that performance begins immediately.

3. Cancellation of future renewals

Where your plan is time-limited (not lifetime), you may use in-app cancellation/refund request flows subject to the rules shown in Subscription & Billing (including any short request window we publish). Cancellation typically lets you use the Service until the end of the current paid period; it does not automatically refund days already granted unless an exception applies.

4. Exceptions

We may refund or credit when:

• A duplicate charge clearly results from a payment system error; or
• The Service is continuously unavailable for more than 48 hours solely due to our infrastructure failure (excluding third-party/internet issues on your side). Remedies may be a proportional refund or equivalent extra access time.

5. How refunds are processed

Approved refunds are returned via the original payment method through our payment provider. Banks may take several business days (often about 3–14) to post the credit.

Subscription & Purchase Terms

2. What you buy

You purchase time-limited access to Min Fire v3 cutting optimization tools as a digital SaaS subscription (for example 1-month, 6-month, or 1-year plans as listed on the site). Features included are those shown at purchase time.

3. Prices and currency

Prices are displayed in USD ($) unless otherwise indicated. The amount charged is the price shown at checkout. Promotional “was/instead of” prices are comparison labels only.

4. Payment

Payment is collected online via our payment provider. You must provide accurate billing information. Failed or disputed payments may result in suspended access.

5. Invoices

Where we issue invoices/receipts, they are provided digitally (for example download from your account or email), based on the billing details you submit.

6. Activation

After successful payment, access is activated on your account as soon as practicable (usually immediately).

7. Consumer rights

If mandatory consumer laws in your country grant non-waivable rights (including withdrawal rights for certain digital purchases), those rights apply to the extent required. Where you request immediate performance of digital content/service and acknowledge loss of withdrawal rights where the law allows, the Refund Policy’s no-refund-after-activation rule applies.

Turkey Personal Data Notice (KVKK)

This notice is provided under Turkish Law No. 6698 (KVKK) for users in Turkey. It supplements our global Privacy Policy.

2. Purposes

• Providing the SaaS service and managing subscriptions
• Payment and invoicing processes
• Customer support
• Optional campaigns/communications where explicit consent exists

3. Data processed

• Identity and contact data (name, email, phone)
• Billing address and tax/ID information you provide
• Service usage and transaction history
• Technical logs (IP, device/session information)
• Payment references (card numbers are not stored by us)

4. Transfers

Data may be transferred to authorized public bodies, hosting providers, payment providers, and other legally authorized parties for the purposes above.

5. Legal bases (KVKK Arts. 5–6)

• Necessity for establishing or performing a contract
• Necessity for establishment, exercise, or protection of a right
• Explicit provision in law
• Explicit consent where required (e.g. certain marketing)

6. Your KVKK rights (Art. 11)

You may request information about processing, correction, deletion/destruction, notification to third parties, objection, and compensation where applicable. Apply via support@nestingoptimizer.com. Applications are generally answered within 30 days; fees may apply per Board tariffs if a cost is incurred.

7. Effectiveness

This notice is effective upon publication. We may update it as needed.
